Choosing a location for a business is a relatively complex process. It involves taking into account a wide variety of criteria, including:

With a duration of six years[1], it is characterised by a great deal of freedom in the way it is drafted, leaving the two parties to organise most of the rental terms themselves (payment of rent, notification of notice of departure, etc.). The tenant company does not have a right to automatic renewal of its lease.
  • The commercial lease has a minimum duration of 9 years, with the possibility for the tenant to give notice once every three years[2]. However, this possibility is not available if the premises are used exclusively as offices: in this case, the tenant can only ask to leave after nine years. It is therefore not a suitable formula for a non-commercial business.

Take advantage of the tax benefits offered in certain areas

In terms of business real estate, the choice of a geographical location may also be guided by financial and fiscal considerations. Certain territories wishing to boost their economic activity benefit from derogatory conditions for the installation of project leaders.

These benefits typically include a temporary tax reduction or exemption from certain social contributions.

  • In urban free zones (UFZ), newly established companies benefit from a 100% exemption from taxation on profits (corporate tax or income tax, depending on their legal status) for a total period of 5 years[3].
  • In the priority neighbourhoods of the city (PNC), a total exemption from local taxes is also possible for a period of 5 years[4]. This includes for example the “cotisation foncière des entreprises” (CFE) and the “taxe foncière sur le bâti” (TFPB).
  • Rural revitalisation zones (RRZ) combine the above advantages, with a total exemption from income tax and local taxes for 5 years[5]. This very advantageous status is intended in particular for small municipalities where there is little economic activity.
